Schering Plough Corporation engaged Kvaerner Engineering & Construction to perform basic and detailed engineering for a new greenfield bulk pharmaceutical plant in Singapore. Kvaerner sought payment of its final invoices and numerous open changes in a Singapore International Arbitration Centre (SIAC) Arbitration. Schering Plough alleged significant damages for alleged engineering deficiencies and the resultant delay and costs to correct and commission the plant. Nielsen-Wurster evaluated Kvaerner’s execution and project management, and evaluated Schering Plough’s allegations and impacts. Nielsen-Wurster presented extensive expert testimony to the Arbitration Panel, which made a significant award in Kvaerner’s favor.
