The Utility Owner and Contractor for this Geothermal
Plant in El Centro, California engaged us
to give expert testimony regarding the construction site
safety program and to evaluate the cause of a Project
accident. We provided expert testimony
regarding the safety program in force during the
Project. The evaluation of the safety program, together
with testimony on the negligence of the craftsman and
the reasons that led to the fall from the structure
under construction, were addressed in depositions. The
case was settled out of court in favor of the Owner and
Contractor.

Wayang Windu Geothermal Power Project
Indonesia
The private Developer of the 400 MW Wayang Windu Geothermal Power Project in Indonesia executed a Power Purchase Agreement with the Indonesia Electrical Authority (PLN) to deliver 200 MW in early 1999. The Developer entered into two construction contracts – one for drilling / reserve development and the second an Engineer Procure-Construct (EPC) for the remainder of the works. Completion of the works impacted by PLN load restrictions. Prior to the PLN
load restrictions, certain delays including a well blowout, alleged
Owner supply delays, change in requirements, differing site conditions
and civil unrest were incurred. We provided a Phase 1 preliminary delay quantification and evaluation of contractor technical issues to guide the Client in developing claim strategies.
We also performed a delay analysis and damages quantification. Based on those analyses, the Client was able to settle the matter favorably. |
