Initially engaged by the Washington State Convention and Trade Center Authority (WSCTCA) Board of Directors to advise on execution issues as the Project neared completion. Following completion, the WSCTCA and its Counsel engaged
Nielsen-Wurster to evaluate construction disputes involving the General Contractor for the Center. The General Contractor and subcontractors asserted a claim for $27 million for costs and damages allegedly caused by actions and failures to act on the part of the Owner, generally associated with claims of error and /or omission and delay by the Designer. The construction cost of this facility was $125 million.
We evaluated each item of approximately two dozen issues of the claim, offering opinions as to Owner-Contractor-Designer responsibility and supporting these opinions with documentation, including cost estimates, schedules and depositions.

Worcester Civic Center

The Developer of the Worcester Civic Center engaged Nielsen-Wurster to provide dispute analyses regarding construction of the 25,000-seat Arena and an Exhibition Hall which was stopped 60 percent into construction. The suspension of the fast-track design-construction Project occurred when the Architect/Engineer alleged deficient workmanship in the fabrication and erection of steel. The Project was completed through a redesign at a total cost more than 200 percent greater than the original Project value. Nielsen-Wurster performed extensive field inspection, testing, design analyses, delay-construction management analyses and damages development and also provided expert testimony. The Arbitration was successfully concluded in favor of Nielsen-Wurster's Client by an award of monetary relief, rejection of all claims against our Client, and a finding of "No Design Deficiency."
